EDEN PRAIRIE, Minn., June 5 / / -- Xiotech Corporation today introduced a turnkey system that proactively captures, classifies, manages and controls the thousands of electronic files organizations generate that can potentially become evidence in a legal or compliance action. Xiotech(R) CEMS(TM) addresses legal, regulatory, governance and business continuity risks by proactively detecting incidents so organizations can quickly manage potential issues as they occur. As a result, organizations are better able to protect intellectual property, enforce organizational policies, manage files to comply with regulations and reduce the cost and risk associated with e-discovery in the event of litigation.

Xiotech research conducted this spring suggests many companies have taken insufficient steps to manage information risk associated with litigation. The online survey of 166 respondents involved in information and storage management found that only 39 percent said they had a working system for implementing legal "holds" to prevent the inadvertent destruction of evidence. Barely 25 percent said their organization had taken any steps to become compliant with the revised Federal Rules of Civil Procedure. In fact, even for the respondents who said the average size of their company's typical lawsuit was more than $100,000, only 40 percent said they had taken such steps.

"Facing a dynamic regulatory market and increase in legal matters involving electronic discovery, organizations must manage information risk to appropriately address these challenges," said Brian Babineau, senior analyst with Enterprise Strategy Group. CEMS Version 1, available now, supports email messages and 390 attachment file types, as well as the bulk import of electronic documents. Upcoming releases will extend CEMS information risk management benefits to additional information sources.

CEMS, which stands for Corporate Evidence Management System, provides executives, compliance officers, records and IT managers, and legal counsel with an information risk management system that transparently captures and controls a broad spectrum of electronic business information as it is authored and routed across an organization. Once information is captured, CEMS inspects each document and provides policy-based, automated classification, based on retention, destruction and regulatory compliance requirements. A copy of each document is then saved in the CEMS repository. As a result, designated individuals can proactively manage and resolve potential incidents faster and more effectively through CEMS search, audit, analysis, tagging, legal hold and production capabilities.

Every document captured in CEMS is treated as if it were a business record and potential legal evidence. Specifically, notifications can be sent to designated individuals for any email or document which violates a policy defined in CEMS. Once notified, CEMS users can immediately access the offending document and accelerate into incident investigation and resolution using CEMS incident management tools.
