Bocada Addresses Federal Rules of Civil Procedure (FRCP) Amendments With Advanced Reporting Functions



Customers Can Use Leading Data Protection Management Product to Establish Key Corporate Information Retention Practices

BELLEVUE, Wash., Sept. 27 // -- Bocada, Inc., the recognized leader in data protection management software, today announced that it is extending its Data Protection Management solution, Bocada Enterprise 4, to help customers meet the complex requirements now facing U.S. organizations due to new amendments to the Federal Rules of Civil Procedure (FRCP). The new rules which mandate how email and other electronic data must be produced for litigation take full effect nationwide on December 1. In a separate announcement released today, Bocada introduced enhanced scalability and compliance support for Bocada Enterprise 4.

Prior to the amendments to the rules, companies required to retain data had no standard procedures to reference for data protection and recovery. In many cases, organizations would just keep all data, driving unprecedented growth in storage capacity as customers required more disk space for the large volumes of data. In addition, as courts requested electronic information from companies in litigation, it was difficult to produce specific data, adding to overall costs and potential fines. The new FRCP amendments will require that companies prove they are taking action to protect data, know where it is located and produce a plan for retrieving that data.

Bocada simplifies how customers can address these sophisticated changes to Rule 26(b)(2)(B) and Rule 37(f) with reporting functions available as a standard feature in Bocada Enterprise 4 for data protection and retention.

Bocada Enterprise 4 reporting functions provide customers with a log summarizing contents of backup tapes. The report identifies the type of information, timeframe and location of the data. This information helps organizations respond to Rule 26(b)(2)(B) which requires that companies justify that data is not reasonably accessible from tape due to undue burden or cost.

The proposed amendments also add a provision to Rule 37(f) that limits the amount of sanctions for certain losses of electronic data. Rule 37(f) is considered a 'safe harbor' to limit court sanctions when businesses are able to prove 'routine, good-faith' information retention operations. In order to leverage the 'safe harbor' companies may need to reveal how the company consistently follows electronic retention practices. Bocada Enterprise 4 customers can leverage reporting functions to show that corporate electronic information is consistently backed up.
