Fortiva Introduces Legal Discovery Features and Cost-Effective Offline Tiered-Storage Option

E-mail Archiving Suite offers Managed Retention With Legal Hold Flexibility to Help Businesses Easily Meet Changing Record Retention Requirements

TORONTO, June 7 - Fortiva, a provider of secure, managed e-mail archiving, today announced the addition of new features that provide a cost-effective way for companies to protect themselves from the impact of legal discovery. The product upgrades, which are built-in to Fortiva's Archiving Suite, include a legal hold feature, improved search for discovery, managed disposition and an offline tiered-storage option.

E-mail is now a dominant form of evidence requested in lawsuits, placing a heavy onus on businesses to ensure that e-mail is managed consistently and can be produced for discovery. In fact, a recent survey performed by Osterman Research, Inc. found that as many as 60 percent of organizations have been ordered by a court or regulatory body to produce employee e-mail. With recent amendments to the Federal Rules of Civil Procedure, businesses are now required to keep any e-mail that might be considered relevant as soon as there is a reasonable expectation that a lawsuit might occur.

"With our offline tiered-storage option, we're giving customers an affordable way to store e-mail records for long retention periods while ensuring those messages are available as required," said Rick Dales, Vice President of Product Management, Fortiva. "By moving data to our searchable offline storage once it is no longer needed for day-to-day business reasons, businesses can maintain access to that information for legal situations without paying the full cost of online storage. And since Fortiva manages all the data for our customers, there is no added hassle for IT."

Fortiva's new features for managed retention and legal discovery include:

Offline tiered-storage option

For businesses that enforce longer retention policies for legal or compliance reasons, Fortiva offers a cost-effective way to store older data offline. Offline data remains fully-indexed and searchable by discovery users and can quickly and easily be brought back online for full access.

Legal Hold

With Fortiva's legal hold feature, companies can create a legal hold repository for each matter. They can then quickly and easily assign messages to that repository to maintain a copy of those e-mail messages indefinitely, regardless of company disposition policies. Users can easily search and export from a hold repository at any time, or delete the repository when the matter is resolved.

Managed Disposition

Fortiva's flexible disposition process allows an authorized user to approve disposition, preventing accidental deletion of required information and helping to reduce the risk of spoliation.

Other key features include:
o Fortiva Infotags for attorney-client privilege enable a company to automatically mark messages that contain privileged information and ensure they are not shared with opposing counsel during a legal discovery request;
o Proximity search capabilities allow for more efficient searching, reducing the time and cost associated with legal discovery;
o PST import services ensure that all legacy data can be made available for a legal hold or discovery situation.
