NTSB Updates Rules Regarding Board Products and Procedures for Hearings and Meetings
WASHINGTON – The National Transportation Safety Board announced today that the NTSB’s Final Rule finalizing changes concerning NTSB products and procedures appears in the Federal Register. The rules will take effect on January 25, 2016, and will be codified at 49 C.F.R. part 845.
The regulatory changes apply to rules governing procedures for hearings and other Board proceedings, as well as descriptions of Board products, such as reports and safety recommendations. The Final Rule reorganizes the rules into subparts to make the rules easier to access and consult. The subparts include: rules describing procedures for hearings; rules applicable to Board meetings; and miscellaneous provisions describing Board products. The NTSB also updated certain terms and information in part 845.
Consistent with the requirements of the Administrative Procedure Act, the NTSB published a Notice of Proposed Rulemaking (NPRM) on March 19, 2015, soliciting comments on the proposed changes. The NTSB received five comments, which are available at www.regulations.gov (Docket No. NTSB-GC-2012-0002). This rulemaking project follows two NTSB’s Federal Register notices from June 2012, which stated the NTSB was undertaking a retrospective review of all agency regulations in order to update them. The NTSB subsequently published a plan for undertaking such updates, which it published in January 2013. As described in the preamble for the Final Rule published in the Federal Register on December 24, 2015, the NTSB is reviewing its regulations in response to Executive Orders directing agencies to update regulations.
