IBM p5 and Oracle e-Business Suite, PeopleSoft, JDE, and/or Retek application software first-in-Enterprise rebate offering
If you acquire a solution that consists of:
one or more eligible new IBM p5 550, 570, 590, or 595 server minimum configurations, and
one or more qualifying new Oracle e-Business Suite, PeopleSoft, JDE and/or Retek application software licenses
you can receive a rebate.
The amount of the rebate will be equal to the total invoice price of the qualifying software license(s) acquired, up to a maximum rebate amount that is dependent upon the eligible new IBM p5 minimum configuration(s) acquired.
There is a limit of one rebate per IBM Customer Enterprise.
In order to qualify, you must provide, on Oracle Corporation letterhead and signed by your Oracle sales representative, a letter stating that Oracle's records show that none of the qualifying application software licenses have ever been installed, at any time, in any location within your IBM Customer Enterprise.
The acquisition of the eligible new p5 minimum configuration(s) and qualifying new application software license(s) must take place within certain specified dates (refer to the Start and/or end dates section).

Start and/or end dates
For hardware purchase transactions, IBM invoices for eligible new p5 minimum configurations must have a date of on or after November 22, 2005.
For hardware lease transactions, signed and accepted Leasing Certificates of Acceptance, or lease contracts with "Deemed Acceptance" for eligible new p5 minimum configurations must have a commencement date of on or after November 22, 2005.
Invoices for the qualifying application software licenses must have a date of on or after November 22, 2005.
There must be no more than 120 calendar days between the invoice date, and/or lease commencement date, of the first and last products acquired in a solution.
Rebate request forms must be received by IBM no later than two months after the invoice or lease commencement date of the last product acquired in a solution.

Additional information/conditions
To receive a rebate, the completed and signed rebate request form (see attached), along with the specified documentation, must be received by the IBM Redemption Center no later than two months after the invoice or lease commencement date of the last product acquired in a solution.
The following are acceptable proofs of acquisition:
a legible copy of the IBM invoice(s) for the eligible new p5 minimum configuration(s), or
a legible copy of the signed and accepted Leasing Certificate(s) of Acceptance or lease contract(s) with "Deemed Acceptance" for the eligible new p5 minimum configuration(s) which list machine types, models, and serial numbers, and
a legible copy of the invoice(s) for the qualifying application software license(s) itemized to include the Vendor and solution name(s).
In addition, you must provide, on Oracle Corporation letterhead and signed by your Oracle sales representative, a letter stating that no qualifying application software license has ever been installed, at any time, in any location within your IBM Customer Enterprise. To determine the company names and locations in your IBM Customer Enterprise, contact John Laszcz at jlaszcz@us.ibm.com.
In Canada, you are responsible for all applicable taxes such as Goods and Services Tax (GST), Quebec Sales Tax (QST), and other sales or value-added taxes which are extra.
IBM reserves the right to modify or withdraw this offering at any time.

Terms and conditions

Software invoices must be either typewritten or computer generated and itemized to show the vendor and application name. Handwritten or altered documents will not be accepted.
The name and company appearing on this form must match the information provided on the invoice/lease documentation.
As proof that you have not previously had any of the qualifying application software license installed, at any time, in your IBM Customer Enterprise, send a letter, on Oracle Corporation letterhead and signed by your Oracle sales representative, stating that Oracle's records show that none of the qualifying application software licenses have ever been installed, at any time, in your IBM Customer Enterprise.
