Modification: IBM storage products no-charge removal program


Effective November 8, 2005, the IBM Storage machine removal program has been modified. Refer to the Modification summary section for a list of changes made with this modification.

All other terms and conditions remain unchanged.

This announcement supersedes United States Marketing Announcement 305-166 , dated October 4, 2005.

The offer

IBM will provide pickup and proper disposal of designated installed storage Replaced Machines, at no additional charge, when you acquire new IBM eligible DASD or tape storage Replacement Machines or upgrade existing installed machines to eligible DASD or tape storage Replacement Machine models.

For a list of qualifying and eligible products, refer to the Qualifying/Eligible products section.

Start and/or end dates
For purchase transactions, invoices for eligible new Replacement Machines must be dated on or after November 8, 2005.

For lease transactions, signed and accepted Leasing Certificates of Acceptance or lease contracts with "Deemed Acceptance" for the eligible Replacement Machines must have a lease commencement date of on or after November 8, 2005.

Contracts required for the no-charge return of designated installed Replaced Machines must be received by IBM no later than 30 calendar days after the date of the IBM invoice or lease commencement date for an eligible new Replacement Machine or upgrade to an eligible Replacement Machine model.

IBM must be contacted to schedule pickup of Replaced Machines no later than six months following the date of the IBM invoice or lease commencement date for an eligible new Replacement Machine or upgrade to an eligible Replacement Machine model.

Additional information/conditions

The lessee of a Replaced Machine financed by IBM Global Financing must purchase the Replaced Machine and pay all related buyout charges before returning it to IBM.

A Replaced Machine currently under an Installation Payment Agreement (IPA) or an Installment Payment Master Agreement (IPMA) must be paid for in full by the customer before returning it to IBM.

IBM reserves the right to modify or withdraw this program at any time.

This program is subject to the terms and conditions of any applicable Agreements.

Eligibility requirements

In order to qualify for no-charge pickup of Replaced Machines, you must do the following:

In the United States, ensure that IBM receives, no later than 30 calendar days after the date of the IBM invoice or lease commencement date for the Replacement Machine, the following documents signed by you:
The ICA Signature Page for Attachments (Z125-4571) with the Trade-Ins Attachment (Z125-4134) selected, and
The ICA Attachment for No Charge Removal of Qualified Machines (Z125-5518)
Have the Replaced Machines installed in a qualifying location as of the date of signing the ICA Attachment
Have the Replacement Machine installed in the same Enterprise where the Replaced Machines were installed
Have clear title to the Replaced Machines, free of any encumbrances, at the time they are picked up by IBM's designated carrier
Contact your IBM representative no later than six months after the date of IBM's invoice or lease commencement date for the Replacement Machine to schedule the pickup of the Replaced Machines.
Trade-In Credits

No trade-in credit will be issued for Replaced Machines.

Replaced Machines

You are responsible for:

Contacting your IBM representative to schedule pickup of the Replaced Machines no later than six months following the date of the IBM invoice or lease commencement date for the Replacement Machine. The Replaced Machines must be available for pickup by IBM's carrier when you contact your IBM representative. IBM will not pay for shipping costs if any other means of return is used.
Removing any data from Replaced Machines. Any IBM service charges incurred in this process or in preparing the machines for pickup are your responsibility.
Disconnecting/deinstalling Replaced Machines before pickup. It is not necessary for IBM Service to pack the machines for shipment. If you request that IBM prepare the machines for shipment, you will be billed for this service.
Requesting that maintenance coverage, if any, for the Replaced Machines be discontinued in accordance with the terms and conditions of the agreements.
Indicating the return address provided by your IBM representative on the bill of lading. Also on the bill of lading, the return materials should be stated as "FAK - OBSOLETE/RETURNED MACHINES AND/OR PARTS."
Ensuring that Replaced Machines are marked "Storage products no-charge removal program tracking # _________" on the exterior packing.
IBM is responsible for:

Making arrangements to remove the Replaced Machines upon receiving your request.
All shipping and storage costs associated with the return of Replaced Machines to IBM, exclusive of any charges for special handling required to remove the Replaced Machines. Special handling includes, but is not limited to:
