Modification: IBM ServerProven rebate offering


Effective November 29, 2005, the IBM ServerProven® rebate offering has been modified. Refer to the Modification summary for a list of changes made with this modification.

All other terms and conditions remain unchanged.

This announcement supersedes United States Marketing Announcement 305-157 , dated September 20, 2005, and Canadian Announcement A05-1418, dated September 20, 2005.

The offer

You can receive a rebate of up to $68,000 USD ($85,000 CAD) if you acquire a qualifying new ServerProven Solution that includes:

an eligible new IBM iSeries(TM), i5 or xSeries® server; or
an eligible upgrade to an installed IBM iSeries or i5 server; and
an eligible ServerProven IBM or non-IBM software solution for the eligible server or server upgrade acquired.
The amount of the rebate will be equal to the lesser of either the invoice price of the ServerProven software solution acquired, or the amount listed in the Qualifying/Eligible products section, which is based upon the eligible server or server upgrade acquired.

Only one rebate will be paid per eligible xSeries server machine type/serial number acquired under this offering.

A single iSeries or i5 server machine type/serial number can qualify for more than one rebate as long as it is acquired new and subsequently upgraded, or was upgraded more than once, and the new acquisition and/or upgrade(s) are each acquired along with an eligible new ServerProven software solution that has not been previously installed on the iSeries or i5 server.

Start and/or end dates
For hardware purchase transactions, IBM invoices for the eligible products must have a date of on or after November 29, 2005.

For hardware lease transactions, signed and accepted Leasing Certificates of Acceptance, or lease contracts with "Deemed Acceptance" for the eligible products must have a commencement date of on or after November 29, 2005.

Invoices for the eligible ServerProven software solutions can have a date that is up to 90 calendar days before or after the invoice date or lease commencement date of the eligible hardware.

Additional information/conditions

ServerProven software solution invoices must include the name of the software solution acquired, the name of the software company, and the purchase price.

In Canada, you are responsible for all applicable taxes such as Goods and Services Tax (GST), Quebec Sales Tax (QST), and other sales or value-added taxes which are extra.

IBM reserves the right to modify or withdraw this offering at any time.

This offering is subject to the terms and conditions of any applicable Agreements.

Rebate claiming process

To receive a rebate, the completed and signed rebate request form (see attached), along with the specified documentation, must be received by the IBM Redemption Center no later than five months after the invoice date or lease commencement date of the eligible hardware.

The following are acceptable proofs of acquisition:

a legible copy of the IBM invoice for the eligible hardware, or
a legible copy of the signed and accepted Leasing Certificate of Acceptance or lease contract with "Deemed Acceptance" for the eligible hardware which lists the machine type, model, features (if applicable), From/To machine type, model, and features (if applicable), and serial number, and
A legible copy of the invoice for the eligible ServerProven software solution which must include the name of the software solution acquired, the name of the software company, and the purchase price.
Can this offer be combined?

This offering cannot be combined with other rebates on the eligible products.

The offer

Terms and conditions

For hardware purchase transactions, the rebate is valid only for eligible hardware invoices dated on or after November 29, 2005, and eligible ServerProven software acquisitions made up to 90 calendar days before or after the invoice date of the eligible new server or server upgrade.
For hardware lease transactions, the rebate is valid only for eligible server or server upgrade signed and accepted Leasing Certificates of Acceptance, or lease contracts with "Deemed Acceptance" for the eligible products with a commencement date of on or after November 29, 2005, and eligible ServerProven software solution acquisitions made up to 90 calendar days before or after the lease commencement date of the eligible new server or server upgrade.

As proof of acquisition, send copies of invoices or lease documentation to the IBM Redemption Center at the address listed below.
Invoices/lease documentation must be either typewritten or computer generated. Handwritten or altered documents will not be accepted.

The name and company appearing on this form must match the information provided on the invoice/lease documentation.
Hardware invoices must include machine type, model, and features (if applicable), From/To machine types, models, and features (if applicable), and serial number.
Signed and accepted Leasing Certificate of Acceptance or lease contracts with "Deemed Acceptance" for eligible new servers or server upgrades must include machine type, model, and features (if applicable), From/To machine types, models, and features (if applicable), and serial number.
All ServerProven software solution invoices must include the name of the software solution acquired, the name of the software company, and the purchase price.
To qualify for the rebate, this completed and signed form, along with the requested documentation, must be received no later than five months after the invoice date or lease commencement date of the eligible server or server upgrade, at:

The IBM Redemption Center will confirm receipt of your rebate request. Retain a copy of this confirmation as proof of timely submission of your request. If you do not receive this confirmation within one week of submission or you need to communicate with the IBM Redemption Center, send an e-mail and reference the "IBM ServerProven rebate offering" in the subject line.
Any rebate request forms lost or misdirected by the Postal Service or other delivery service are not the responsibility of IBM or the IBM Redemption Center.
Allow six to eight weeks from the time IBM receives your complete and accurate documentation for your rebate check/cheque to arrive.
This offering is void wherever prohibited or restricted by law.
