Novaflex Group, The
20 East Pearce Street, Unit #1
Richmond Hill, L4B 1B7
Canada

Press release date: August 22, 2006

Richmond Hill, Ontario - The Novaflex group recently received a "notice of acceptance" from the United Sates Patent and Trademark Office, regarding their trademark name - "Novaflex". With naming rights becoming more of an issue within the supply chain as of late, this latest development will ensure that the end-user is getting the quality and consistency associated with the Novaflex Group and its affiliated companies.

Ian Donnelly, President of the Novaflex Group re-iterated the importance of securing these trademarks, "We've had trouble in the past with naming rights, as the laws are different in Canada compared to the U.S. We just wanted to nail this down."

Files from Washington indicate that "...notice issued by the U.S. Patent and Trademark Office ("PTO") indicating that the Combined Declaration of Use and Incontestability which were filed on the "NOVAFLEX" mark has been accepted and acknowledged by the PTO." This basically acknowledges the Novaflex Group as sole owners of the trademark "Novaflex" and this ownership is now "incontestable" under U.S. Patent and Trademark law.

With the industry battle over product "laylines" having no foreseeable end in sight, Novaflex has now effectively ended the discussion with an exclamation mark with regard to their products. With this trademark protection, Novaflex have protected the end-user's right to choose products based on brand equity and quality - which Novaflex feels should supersede any and all arguments over naming rights within the supply chain.
